Students are advised to be aware of the following information before signing a housing agreement. When you sign your housing agreement, you accept the conditions and terms set forth by this agreement. At times, students overlook their responsibility to follow the policies in this booklet and the UNCW Handbook and Code of Student Life. This could result in a financial charge and/or disciplinary action.
Please read the following information carefully. It contains descriptions of important elements of your student residence contract.
HOUSING FEE
All students are required to make a non-refundable Housing fee of $100. A limited amount of housing is available for those students requesting on-campus accommodations for the 2007-2008 academic year. Therefore, it is essential that the housing application be returned to the Office of Housing and Residence Life as quickly as is possible. Housing applications will be accepted on a space-available basis. Applications that are received after on-campus housing is filled will be placed on the on-campus housing waiting list.
PERIOD OF CONTRACT
This license contract is a binding legal agreement, which details a set of terms and conditions that the applicant must follow. Additionally, the applicant understands that he/she is requesting a space and committing to on-campus housing for the academic year of 2007-2008. The applicant accepts responsibility for the full room and board charges as outlined in the license contract. The applicant understands that the license contract is for both semesters of the academic year (fall 2007 and spring 2008). The applicant understands that he/she is obligated to perform on the contract through the final closing of the residence halls for the 2008 spring semester even if the applicant enters into the contract for spring semester only. Students withdrawing from the university will receive a pro-rated refund for the unused portion of their room and board consistent with the university policy on refunds. There will be no refund made in the case of a student being suspended from the university for disciplinary reasons.
A. Students withdrawing from the university during the school year will be held liable for the pro-rated cost of room and board charges based upon the date they move out of campus housing. This amount may be billed to the student(s) independent of any university-prorated refund.
B. NO CANCELLATION OF THIS CONTRACT FOR THE FALL SEMESTER WILL BE ACCEPTED AFTER JUNE 1, 2007. Enrolled students will be responsible for the full cost of room and board for the contract period. Students deciding not to attend the university after that date will be relieved of the contractual obligations if notification is received in writing.
C. In order to live in university housing, a student must enroll full-time (12 hours undergraduate, 9 hours graduate) for each semester in residence. Exceptions to this policy must be approved by the Director of Housing and Residence Life or his/her designee. All exceptions will require a strong recommendation from the student’s Academic Advisor. The student should be making reasonable progress toward the completion of a degree.
D. Occupancy is defined by issuance of a key to the student for a specified room and does not require actual physical presence by the student and his/her possessions.
THE HOUSING CONTRACT IS FOR BOTH THE FALL AND SPRING SEMESTERS. ROOM AND BOARD FEES ARE PER SEMESTER COSTS. Students entering into this agreement in the fall semester are liable for the room and board charges for both the fall and spring semesters. Refunds of room and board plans for students officially withdrawing from the university will be on a prorated basis with an administrative withdrawal fee.
The University reserves the right to change the room and board rates without notice.
ROOM ASSIGNMENTS
The University's acceptance of the application does not guarantee a specific room assignment. Room assignments are primarily based upon the date of application and personal data listed on the contract.
TERMS OF CONTRACT
The university reserves the right, upon reasonable notice and for good cause, to:
• cancel the housing agreement or change a student's assignment in the interest of health/sanitation, discipline, administrative expediency, or as considered necessary
• cancel contracts of students not making reasonable progress toward the completion of a degree.
• cancel contracts of students declared academically ineligible, causing loss of room assignment.
• cancel contracts of students who fail to make payment of required charges by announced deadlines.
• cancel contracts of students who fail to comply with state or federal laws, residence hall policies and regulations, or rules and regulations adopted by the University of North Carolina at Wilmington or the General Administration of the University of North Carolina system.
• cancel contracts of students who fail to keep a roommate.
• charge and collect damage fees for unauthorized use of equipment, building or room alterations, health and safety violations, and for special cleaning necessitated by improper use of rooms, public areas, equipment, damages, or vandalism.
• change room and board rates and Housing and Residence Life policies without prior notice.
• enter student rooms as necessary for repairs, inspections, and enforcement of university policy or state law.
BEHAVIORAL EXPECTATIONS
The student agrees to comply with the rules, regulations and conditions as contained in this agreement, together with such rules, regulations and conditions found in the UNCW Handbook and Code of Student Life.
CONTRACT RELEASE
Students may be released from their contractual obligations for on-campus housing without forfeiture of the second semester charges in the following cases:
A.
withdrawal from the university
B. marriage (proof required)
C. transfer to another university (proof required)
D. graduation
Requests to be released from spring semester obligations under one of the above conditions must be made in writing to the Office of Housing and Residence Life prior to November 1, 2007 to avoid a $100.00 late cancellation charge.
TEMPORARY ASSIGNMENTS
Some students may be placed in temporary assignments at the beginning of the year. All students involved will be notified and moved to permanent assignments as soon as possible, generally by the end of the sixth week of classes.
CONSOLIDATION
At the beginning of each semester, students who have no roommate due to cancellation or withdrawal will be assigned another roommate or may be asked to consolidate by moving to another room. Consolidation is used at the discretion of the Office of Housing and Residence Life.
SINGLE ROOM OPTION
When space allows, double rooms may be occupied privately for $300.00 over the regular room rate.
ROOM CHANGES
Approximately two weeks after classes begin, a designated time will be set aside for room changes. These changes will be made through the Office of Housing and Residence Life when space is available. Any student making non-approved room changes (any change not approved by the Office of Housing and Residence Life) will be charged a fine of at least $25.00 and these students may be required to move back to their original room. Check-In and Check-Out of your room must be completed through any of the RAs in your area. Failure to check-out through your RA, may result in a fine of at least $25.00 for improper Check-Out. Access to an assigned room is given to students only during regular academic sessions, which require their presence on campus. Students are required to vacate their rooms before the designated closing times. Failure to leave the building at the time of closing during break periods can result in a late Check-Out charge of $25.00 per hour for each hour the student is late. Students do not have access to their rooms during vacation periods when the halls are officially closed.
PERSONAL PROPERTY
The University does not assume responsibility for loss or damage from any cause to the personal property of the student. It is suggested that the student consult his/her insurance agent concerning the availability of protection against such loss. Students should consider acquiring renter's insurance to cover personal losses not covered by other forms of insurance.
The student or other party to this contract will indemnify and save harmless the University of North Carolina Wilmington and its Trustees, agent, and employees from all liabilities, losses, costs, damages, claims or causes of action of any kind or nature whatsoever, and expenses, including attorney’s fees, arising or claimed to have arisen out of any injuries or damages received or sustained by the student as a result of negligence on the part of the University of North Carolina Wilmington, Trustees, agents or employees, in the execution, performance or enforcement of this agreement, and any injuries or damages received or sustained by any third person as a result of any intentional or negligent acts or omissions on the part of the student, whether any such injuries or losses occur in residence hall rooms, public areas or elsewhere on the campus.
WAITING LIST
The Office of Housing and Residence Life will allow interested students to place their name on a waiting list if the residence halls are full. On-campus housing is not required by the university, nor is it guaranteed. As space becomes available, students on the waiting list will be offered on-campus housing.
